Trudeau Bans the Unvaccinated from Leaving the Country and from Earning a Living


The Justice Centre is deeply concerned about the federal government’s announcement, which appears to be a violation of the Charter of Rights and Freedoms. The right to freedom of movement is enshrined in section 6 of the Charter, and the right to earn a living is protected by section 7. The federal government has not provided any evidence that these rights can be limited in this way without violating the Charter.

The Justice Centre believes that all Canadians should have access to accurate information about vaccines, and should be able to make an informed decision about whether or not to receive them. Vaccination should never be mandatory, as it violates fundamental human rights. We urge the federal government to respect the rights of all Canadians and refrain from introducing measures that would limit their freedoms without due process or legal justification.

  • “The government is seeking to have 100% of Canadians injected with the experimental mRNA vaccine, which has not been subjected to any long-term testing on humans,†states lawyer John Carpay, President of the Justice Centre.

The travel mandate is part of the government’s effort to protect Canadians from the spread of Covid-19. The government has stated that it will not allow any unvaccinated person to leave Canada, regardless of their destination. This includes both international and domestic travel.

The travel mandate also applies to those who are vaccinated but have not yet received their second dose. Those who have received both doses are exempt from the travel restriction, as long as they can provide proof of vaccination.

The federal government has also announced that it will be introducing a digital health passport system in order to verify whether or not an individual has been vaccinated against Covid-19. This system will be used by airlines and other transportation companies to ensure that only those who have been vaccinated are allowed to board flights or trains leaving Canada.

The Canadian government is hoping that this new measure will help reduce the spread of Covid-19 and keep Canadians safe while travelling abroad. It is also hoped that this measure will encourage more people to get vaccinated so that they can enjoy the freedom of travelling without fear of contracting the virus.

  • “We were recently promised, this past summer, that life would go back to normal once 70% of Canadians were injected with mRNA. This high vaccination rate has been achieved but has not stopped the spread of the virus. The new mRNA vaccine also provides no guarantee against the Delta variant,†continues Mr. Carpay.

He also said that the government is considering other measures, such as travel restrictions and quarantine requirements.

The Prime Minister’s comments are in line with public health experts’ advice to take extra precautions to protect vulnerable populations from the spread of COVID-19. Vaccination is one of the most effective ways to reduce the risk of infection, and it is important for Canadians to get vaccinated if they can. The government is exploring additional measures to ensure that unvaccinated Canadians are not putting others at risk, such as travel restrictions and quarantine requirements.   • “Government data and statistics from every Canadian province, and from countries around the world, tell us that children, teenagers and young adults face no serious threat from Covid, which makes the Prime Minister’s rhetoric about saving children highly misleading,†continues Mr. Carpay.
  • “Medical reports and scientific studies make it clear that both vaccinated and unvaccinated people spread Covid-19. There is no scientific basis for turning unvaccinated Canadians into second-class citizens,†stated Allison Pejovic, Justice Centre Staff Lawyer.

It is possible that Canada’s provincial and federal governments may eventually require more than two injections to qualify for full vaccination. However, this decision would be based on the advice of public health experts and would likely only be implemented if there was a clear benefit to doing so. It is also important to note that any changes in the number of required vaccinations would likely be gradual, allowing individuals time to adjust and plan accordingly.

  • “Governments throughout history have used the notion of ‘science’ to support their policies, along with various appeals to public health, safety, security, morality, and so on. No government will violate human rights without putting forward a good-sounding justification, such as the war on terrorism, communism, online hate, drugs, or a nasty virus,†continues Mr. Carpay.

However, the data and statistics show that Covid is much less deadly than the Spanish Flu. According to the World Health Organization, the global mortality rate for Covid-19 is 0.6%, compared to 2.5% for the Spanish Flu. In addition, while the Spanish Flu had a mortality rate of up to 20% in some countries, no country has seen a mortality rate higher than 5% from Covid-19.

These facts demonstrate that Dr. Ferguson’s predictions were overly pessimistic and that Covid-19 is not nearly as deadly as he predicted it would be. This should provide some comfort to those who are worried about the virus and its potential impact on their lives and health.

Over the past 18 months, government-funded media have been very successful in persuading the majority that vaccine passports (and lockdown policies preceding them) are based on science. When people hear a message thousands of times, they believe it to be true,†continues Mr. Carpay.
  • “The Justice Centre is profoundly disturbed that these federal mandates will prevent unvaccinated Canadians from leaving the country. Such a mandate is an egregious and unacceptable infringement of Canadians’ constitutionally protected mobility rights. There is no scientific justification for this,†concludes Ms. Pejovic.

The government must ensure that any new laws or regulations are consistent with the Canadian Charter of Rights and Freedoms, which guarantees certain fundamental rights and freedoms to all Canadians. If a law is found to be unconstitutional, it can be challenged in court. The court may then declare the law invalid or order the government to amend it so that it complies with the Charter.
